Aggravated DWI

Aggravated DWI is a newly enacted law that creates this new category of DWI based upon the allegation that the driver had a BAC of .18 or above.  Although this new law has increased penalties upon conviction, including higher fines and a mandatory license revocation of one year, perhaps the most important aspect to this law are plea-bargaining restrictions that would not normally allow a District Attorney to offer a deal to the reduced charge of Driving While Ability Impaired (DWAI).
